19.2.1BuyerwarrantsthatSeller’snominatedvesselwillbeallowedtodischargehercargowithinseventy-two(72)freerunninghoursSHINC’plussix(6)hoursNOR,andhowever,maintainingattheship’smanifoldsanaveragedischargepressureofnotmorethanten(10)kilogramspersquarecentimeter(kg/cm2).
19.2.2NoticeofReadiness(NOR)shallbegiven,onship’sarrivalattheBuyer’sdesignateddischargeport(s),bytheship’smastertoBuyerand/orAgent,byradio,cableorbyhand,atanytimeincludingSaturdays,Sundaysandholidays.
19.3.2DemurragesamountshallbecomputedattheCharteredpartyrate.Forthispurpose,SellershallprovidetheBuyerwithacopyoftheoriginalCharterParty.
19.3.3Demurrageswillbebasedondailyrateorpro-ratathereof.
19.3.4Ifthevesselarrivesatthedischargeterminalaheadoftherangeofdaysinaccordancewithclause20.1.3,suchnoticeshallonlybeeffectiveasfrom00.01hoursonthefirstofthesedays,unlessthedischargeterminalbeginstodischargethevesselbeforesuchtime.Inthecaseofthevesselarrivinglaterthantherangeofdaysaccepted,thedischargeterminalwilluseitsbesteffortstominimizethedelaytodischarge.However,insuchcases,LAYTIMEwillonlystarttocountuponthevesselbeingall-fastinberth.
CLAUSE20LETTEROFINDEMNITY(ASPERANNEX(D)
20.1IncasetheSellerisnotabletodelivertotheBuyerinduetimethesetoforiginalbillsofladingofeachcargo’sbatch,andthentheSellerhastoprovidetheBuyerwithahard-copyofletterofindemnitytotemporarilymissingoriginalbillsoflading.
20.2WordingofthisletterofindemnitytobeacceptabletotheBuyerandshallceasetohaveeffectuponpresentationoftheoriginalbillsoflading.
20.3Intheeventofunusualcircumstances,whichpreventtheSellerfrompresentingtotheBuyertheoriginalbillsofladingwithinasixty(60)daysperiod,theSelleragreestoprovidetheBuyerandtheBuyeragreestoacceptasecondandsubsequentletterofindemnitycoveringthecargobatchinquestion.
