COURSEDESCRIPTION
Thiscoursewilladdresssomeoftheissuesassociatedwiththegovernmentalregulationofinternationaltrade,throughaproblemorientedapproach.Atleasttworegulatorysystemswillbeconsideredinalmosteveryproblem,onebeingtheregulatoryregimeembodiedinthedomesticlawofthecountryofimportorexport,andtheotherbeingthesystemofinternationalagreements(suchasWTO/GATTandNAFTA)thatareintendedtolimittheactionswhichmaybetakenbyindividualgovernments.Theimpactof"globalization"withinthisframeworkwillalsobeconsidered.
Threemajorareaswillbeexplored(1)tariffsandnon-tariffbarrierstotrade,(2)domesticresponsestoimportcompetition,and(3)traderegulationandinternationaleconomicrelations.Thesearetopicswhichpotentiallyconcernanybusinessdealinginternationally,fromglobalmultinationalcorporationstosmallstart-upventuresdesiringtoexpandabroad.
Thelawsregulatinginternationaltradebuilduponconceptsandprincipleswhicharestudiedingreaterdetailinabroadnumberofothercourses,suchasAdministrativeLaw,Antitrust,ComparativeLaw,Conflicts,InternationalArbitration/DisputeResolution,andInternationalLaw.Whilenoneofthesearerequiredasprerequisites,studentsmayfindithelpfultoconsultthestandardtreatisesasquestionsarise,particularlyinInternationalLawandInternationalEconomicLaw.Additionally,InternationalTradeRegulationandInternationalBusinessTransactionsshouldberegardedascomplimentarycourseofferings.Althoughitissometimesdifficulttoseparate"public"and"private"lawissueswhendealingwithinternationalbusiness,generallyspeakingthiscoursefocusesuponpublic(governmental)controloftrade,whereasInternationalBusinessTransactionsemphasizestheissuesassociatedwithputtinginternationaltransactionstogether.Thus,while"TradeReg"and"IBT"arerelatedofferings,neithercourseisaprerequisitefortheother.

Folsom,Gordon&Spanogle,InternationalBusinessTransactions:AProblemOrientedCoursebook,(SeventhEdition,2004)andtheaccompanying2004DocumentsSupplementarerequired.Additionalmaterialwillbedistributedvialinksinthissyllabusorinhandoutsdistributedatvarioustimesduringthesemester.
ThereisalsoawealthofadditionalusefulmaterialavailableontheInternet-withanumberoflinksspecificallyprovidedinthissyllabus.Whilenoothermaterialsarenecessaryorrequiredforthecourse,thosewhowouldlikeanadditionalsecondarytextmightwanttoconsiderJeroldA.Friedland,UnderstandingInternationalBusinessandFinancialTransactions(2002).
Moreover,youwillfindthatallthemajornewsmediawillrunstoriesconcerningtheissuesaddressedinthiscourseonaweekly,ifnotdaily,basis.Followingthesestorieswillprovideaddedbackgroundandcontextformanyofthetopicswewillbeconsidering.
