Thegeneralaverageisinthemaritimelawauniquelegalregime,itsexistencehastheremotehistory,thissystemonceprosperousandhasmadetheimportantcontributionprosperouslyfortheseafaring,torealizeinthemarinegoodstrafficthefairassignedrisk,themaintenancecargoallquarterslegitimaterightsandinterests,hasplayedthevitalrole.Sothatbuttherecentyearssimplifiedevenabolishesthegeneralaveragecallgraduallytogetup,urgestendencywhichthegeneralaveragesystem'ssettingrangepresentedreducesgradually,underthissituation,shouldedthequestionwhichabolishedtoraiseagainthissystemtheprogramisextremelymeaningful.
WithChina'sforeigntradegrowing,GAbeganintheeyesofthepeoplemoreandmoreimportantchange,howdesignation,howtodistinguish,andsoonarehowtodealwithweneedtoconsiderandputintopracticeissues.However,today'smarineinsurancehasbeensopopular,soitwouldberaisedthisquestion:GAsystemisalsonecessarytocontinuetoexist,especiallysinceGAitselfhasbecomeoneoftheunderwritingrisk.
Thispaperisdividedintothreeparts,startingwiththegeneralaverageofthesystemstartingwiththedevelopmentoftheoriginandhistoryoftheevolutionofgeneralaveragewasmorecomprehensivesystemofinspection,accordingtoitscharacteristicsatdifferenttimes,thewholesystemofgeneralaverage3000yearsofdevelopmentCourseroughlybedividedintofourstages:theoriginalcustomarystage,legislationandregulationsinearlystages,regionaldevelopmentstage,theinternationalphaseofreunification,andthecharacteristicsofthevariousstagesdiscussed.
Thesecondpartmainlyongeneralaverageinthecurrentsystemofmaritimetransportmorefrequent,morecomplexcontextofanewera,ledtothegeneralaverageontheretentionorabolitionofthecontroversialsystem,theretentionorabolitionofthesystemofdisputewasanalyzed.Summedupshouldbethecorrectviewofthesystemandtheabolitionofthereservation.
