本文探讨了当前社会和法学界热议的沉默权问题.在对沉默权的涵义和历史发展作出全面研究的基础上,分析说明了沉默权具有的价值.沉默权的价值体现为对被追诉人的价值和对社会的价值两方面,尤为突出的是给社会带来的平等和程序正义的价值.沉默权也具有负价值,主要是给司法机关指控犯罪造成了困难.针对我国当前对沉默权的否定态度,本文通过结合沉默权的价值理论和我国国情,分析说明了在我国建立沉默权制度利大于弊,我国需要引入沉默权制度.最后对如何建立符合我国国情的沉默权制度发表了看法,提出我国应建立有限的沉默权制度.
